1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and PubSpy ("Company," "we," "us," or "our") concerning your use of the PubSpy browser extension and website located at https://pubspy.io (collectively, the "Service").

By installing the extension, accessing the website, or using any part of the Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you do not have permission to use the Service.

2. Use License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download, install, and use the PubSpy browser extension for your personal or business purposes
• Access and use the PubSpy website and related services
• Use the Service in accordance with its intended functionality

License Restrictions

You agree NOT to:

• Modify, reverse engineer, decompile, or disassemble the Service
• Copy, redistribute, or resell any part of the Service
• Remove or alter any proprietary notices or labels
• Copy PubSpy source code, trademarks, protected page content, or non-public data without permission; lawful competitive research and independently built products remain allowed
• Use the Service for any illegal or unauthorized purpose

3. Prohibited Uses

You may not use the Service:

• In any way that violates any applicable federal, state, local, or international law or regulation
• To transmit or procure the sending of any advertising or promotional material, including any "junk mail," "chain letter," "spam," or similar solicitation
• To impersonate or attempt to impersonate the Company, a Company employee, another user, or any other person or entity
• To engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Service
• To introduce any viruses, trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful
• To attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Service
• To use the Service in any manner that could disable, overburden, damage, or impair the Service
• To scrape, harvest, or collect data from the Service through automated means
• To violate the privacy rights of others or collect personal information without consent

4. Subscriptions and Payments

Analysis Credits

An eligible newly verified account currently receives 100 promotional credits once, limited to three starter grants per IP address per UTC month. An authenticated user may claim 10 promotional credits once per UTC calendar day, limited to three claiming accounts per IP address per day. These IP-address limits reduce automated multi-account abuse and do not apply to purchased credits. Each initial website analysis and each follow-up question uses 5 credits. Failed provider requests are automatically refunded when the server can verify that the request did not complete. Duplicate request identifiers do not create duplicate charges. Promotional credits have no cash value.

The hosted checkout shows the current price, included credits, renewal terms, and any taxes before purchase. Server-side product definitions control the final entitlement; interface text cannot change a price or credit grant.

Billing

• Monthly and annual subscription fees are billed in advance; prepaid credit packs are one-time purchases
• All fees are in USD unless otherwise specified
• Price or entitlement changes apply prospectively and will be shown before purchase or renewal
• Checkout is hosted by pay.yito.ai, and payment details are processed by Stripe

Automatic Renewal

Monthly and annual plans renew according to the renewal terms shown at checkout unless cancelled before the next billing date. Prepaid credit packs do not renew. Cancellation stops future renewal and does not erase unused credits already granted, unless required by law or stated otherwise at checkout.

5. Refund Policy

Refund eligibility, request windows, consumed-credit limits, and processing expectations are stated in the Refund Policy. Use the support form with the order reference if a payment, renewal, or credit grant is incorrect. Never submit card details. Nothing in these Terms limits non-waivable consumer rights.

6. Intellectual Property Rights

The Service and its original content, features, and functionality are and will remain the exclusive property of PubSpy and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

User Feedback

You retain ownership of feedback you submit. You grant PubSpy a worldwide, non-exclusive, royalty-free license to use non-confidential feedback to improve the Service, without an obligation to implement it or pay compensation.

7. Disclaimer

We do not warrant that:

• The Service will function uninterrupted, secure, or error-free
• The results obtained from the Service will be accurate or reliable
• The quality of the Service will meet your expectations
• Any errors in the Service will be corrected

The data and AI-generated analysis provided by PubSpy are for informational and research purposes only. Each initial report is formatted as a 30-section private case study, but formatting does not guarantee truth. AI output, web-search results, traffic estimates, revenue estimates, registration data, reviews, and social-media observations can be incomplete, outdated, or incorrect. Verify material claims against primary sources before making product, financial, legal, or business decisions.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL PUBSPY, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION:

• Loss of profits, data, use, goodwill, or other intangible losses
• Resulting from your use or inability to use the Service
• Any unauthorized access to or use of our servers
• Any interruption or cessation of transmission to or from the Service
• Any bugs, viruses, or trojan horses transmitted through the Service
• Any errors or omissions in any content

Our total liability shall not exceed the amount paid by you, if any, for accessing or using the Service during the six (6) months preceding the claim.

9. Indemnification

You agree to defend, indemnify, and hold harmless PubSpy and its licensors, employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including attorney's fees) arising from:

• Your use of and access to the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Any content or data you submit through the Service

10. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including:

• Breach of these Terms
• Non-payment of fees
• Fraudulent or illegal activity
• At our sole discretion

Upon termination, your right to use the Service will cease immediately. All provisions of these Terms that should reasonably survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

11. Governing Law and Jurisdiction

Mandatory consumer-protection and conflict-of-law rules that apply to you are not displaced by these Terms. Before starting formal proceedings, please use the support form so both sides can attempt a good-faith resolution. We do not name a fictional jurisdiction, court, or arbitration body where no verified operating-entity disclosure exists.

12. Miscellaneous

Entire Agreement

These Terms constitute the entire agreement between you and PubSpy regarding the Service and supersede all prior agreements and understandings.

Waiver and Severability

Our failure to enforce any provision of these Terms shall not be considered a waiver. If any provision is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes via email or through the Service. Your continued use after such modifications constitutes acceptance of the updated Terms.
